Caracol se réserve le droit de modifier sans préavis et à sa seule appréciation les présentes modalités et conditions.

AUTORISATION D'UTILISER DES DOCUMENTS ÉLECTRONIQUES

Par les présentes, vous autorisez l'échange de documents et d'information entre vous et Caracol par Internet ou par courrier électronique, et vous convenez que la présente convention ainsi que toute confirmation de commande acceptée par Caracol sous format électronique équivalent à une convention originale écrite sur support papier entre vous et Caracol. Vous convenez également que l'ensemble des ententes, avis, informations et autres communications que nous vous faisons parvenir électroniquement satisfont aux exigences légales suivant lesquelles ces communications doivent être faites par écrit.

AUTRES DOCUMENTS, ENTENTES ET POLITIQUES

L’utilisation du présent site web est régie par les Conditions d’utilisation du site Web distinctes et par notre Politique de confidentialité. Vous déclarez avoir lu les autres politiques et vous acceptez d’être lié par leurs modalités et conditions. Malgré ce qui précède, les dispositions de la présente convention ont préséance sur les dispositions des autres politiques; en cas d’incompatibilité entre les dispositions de la présente convention et celles des autres politiques, les dispositions de la présente convention s’appliqueront. COMMANDES DE PRODUITS

Avant de transmettre une commande pour l'achat de produits par l'intermédiaire de ce site web, vous verrez d’abord une fenêtre permettant de confirmer votre commande (la « confirmation de commande ») qui présente, entre autres choses, le ou les produits commandés, le prix d'achat ainsi que les frais d'expédition et les taxes applicables. Sous réserve de toute disposition à l’effet contraire contenue dans la Loi sur la Protection du Consommateur applicable au Québec, lorsque vous passez votre commande (en cliquant sur le bouton « Confirmer la commande»), votre commande constitue une offre que vous faites à la Caracol en vue de l'achat du ou des produits décrits dans la confirmation de commande, moyennant le prix et les autres frais, modalités et conditions énoncés dans la confirmation de commande. Caracol n'est pas lié par les commandes tant qu'elle ne les a pas acceptées. L'acceptation de votre commande par Caracol est attestée au moyen d’un courriel de réponse transmis par Caracol et dans lequel elle indique que votre commande a été acceptée.

Les commandes des clients pour des produits devant être livrés dans la zone continentale des États-Unis (à l'exclusion de l'Alaska). Les commandes passées aux États-Unis ne sont pas assujetties à la taxe fédérale canadienne sur les produits et services, ni aux taxes de vente provinciales applicables, ni aux autres taxes et droits canadiens associés à une commande de produits.

CE SITE ET SON CONTENU NE DOIVENT PAS ÊTRE CONSIDÉRÉS COMME UNE OFFRE DE VENTE DE PRODUITS OU DE SERVICES.

ÉTABLISSEMENT DU PRIX DES PRODUITS

Tous les prix indiqués sont en dollars canadiens et toutes les commandes de produits sont traitées en dollars canadiens. Bien que Caracol s'efforce de fournir des renseignements exacts sur les produits et des prix précis, il persiste un risque d'erreur. Caracol se réserve le droit de corriger toute erreur dans le prix d'un produit et les renseignements relatifs à un produit, et de modifier les prix des produits à tout moment, sans préavis. Caracol peut seulement confirmer le prix d'un produit une fois que vous avez passé une commande. Si le prix ou les renseignements relatifs à un produit (qui figurent sur le site et/ou dans la confirmation de la commande) sont erronés Caracol peut, à sa seule appréciation, refuser votre commande ou l'annuler, tant avant de l'avoir acceptée qu'après. Si un prix est erroné, Caracol annulera votre commande ainsi que tous les frais qui ont été facturés, puis communiquera avec vous afin de vous inviter à passer une nouvelle commande pour le produit au prix exact.

ANNULATION

Caracol se réserve le droit, à sa seule appréciation, de limiter les quantités, de résilier des comptes et de refuser ou d'annuler une commande, y compris après que la commande ait été transmise, même si celle-ci a été confirmée ou acceptée ou facturée à votre carte de crédit. Si votre commande est annulée après que votre paiement ait été traité, vous serez intégralement remboursé par Caracol

AJUSTEMENT DE PRIX

Caracol n'offre pas la possibilité d'obtenir un ajustement de prix pour les achats effectués en ligne.

MODALITÉS DE PAIEMENT

Les modalités de paiement des produits achetés par l'intermédiaire de ce site sont établies à la seule appréciation de Caracol. Le paiement sera effectué par carte de crédit à moins qu’un autre mode de paiement, prévu à l'avance, n’ait été accepté par Caracol. Les paiements effectués par carte de crédit sont assujettis à l'approbation de l'institution financière qui a émis la carte de crédit.

EXPÉDITION ET TAXES

Les commandes effectuées en ligne sont traitées dans les 24 à 48h ouvrables et expédiées par Fedex, Purolator ou Poste Canada (1 à 4 jours ouvrables). Les frais de transport varient en fonction de l’expédition choisi ainsi que du poids et de la taille des articles commandés.

Caracol expédiera le ou les produits que vous avez commandés conformément au mode de livraison que vous avez choisi et à l'adresse indiquée dans la confirmation de la commande. Les délais de livraison indiqués par Caracol sont approximatifs. Caracol décline toute responsabilité à l'égard des dommages ou des coûts découlant de tout retard dans la livraison.

Sauf indication contraire, les prix n'incluent pas les frais d'expédition et de manutention ni les taxes de vente fédérales, étatiques ou provinciales applicables. Les frais d'expédition et de manutention et les taxes seront présentées séparément dans la confirmation de la commande pour chaque commande, selon le cas. Les clients canadiens sont assujettis à l'ensemble des taxes de vente, des taxes d'utilisation, des taxes sur les produits et services, des taxes de vente harmonisées et des autres taxes et droits associés à la commande. Les commandes passées aux États-Unis ne sont pas assujetties à la taxe fédérale canadienne sur les produits et services, ni aux taxes de vente provinciales applicables, ni aux autres taxes et droits canadiens associés à une commande de produits. Toutefois, les clients américains sont assujettis à l'ensemble des taxes de vente, des taxes d'utilisation et des autres taxes et droits associés à leur commande qui sont imposés par un État ou un territoire aux États-Unis.

PROPRIÉTÉ; RISQUE DE PERTE

Tous les produits achetés auprès de Caracol vous sont livrés par une société de livraison tierce, aux termes d'un contrat d'expédition. Vous devenez le propriétaire du ou des produits et assumez les risques de perte au moment où la société livre le ou les produits à la société de livraison tierce.

RETOURS

Tous les retours de produits sont assujettis à la Politique de retour de la société, dont les modalités sont intégrées dans les présentes par renvoi.

Hereby, you authorize the exchange of documents and information between you and Caracol through the Internet or by electronic mail, and you agree that this convention as well as any confirmation of an order accepted by Caracol in electronic form is equivalent to an original convention written on paper between you and Caracol. You also agree that all arrangements, notices, information and other communications that we send you through email satisfy the legal requirement of a written communication.

OTHER DOCUMENTS, AGREEMENTS AND POLICIES 

The use of this website is subject to the separate Terms of Use of the site and to the Privacy Policy (the « other policies »). You declare having read the other policies and you accept to be bound by their terms and conditions. Notwithstanding the aforesaid, the provisions of this convention take precedence over the provisions of the other policies; in case of inconsistency between the provisions of this convention and those of the other policies, the provisions of this convention will apply. Other terms and conditions can apply to the purchase of products and the use of other sections of this website.

ORDERING PRODUCTS

Before transmitting an order to purchase products through this website, you will first see a window allowing you to confirm your order (the « order confirmation ») that displays, among other things, the ordered products, the purchase prices as well as the shipping fees and the applicable taxes. Subject to any express provision to the contrary enclosed in the Quebec's Consumer Protection Act, when you place your order (by clicking on the button « Confirm the order »), your order is an offer you make to Caracol for the purchase of the products described in the order confirmation, in exchange for the price and other fees, terms and conditions stated in the order confirmation. Caracol is not bound by the orders as long as it has not accepted it. An answer sent by email by Caracol will confirm that your order has been accepted.

Orders placed from the United States are not subject to the Canadian Federal Goods and Services Tax, nor the applicable provincial sales taxes, nor the other Canadian taxes and rights applicable to a product order.

PRICE CALCULATION 

All the indicated prices are in Canadian dollars and all product orders are treated in Canadian dollars. Even if Caracol is doing its best to provide accurate information on the products and precise prices, errors may occur. Caracol retains the right to correct any error in the price of a product and the information about a product, and to modify the price of the products at any moment, without notice. Caracol can confirm the price of a product only once you have placed an order. If the price or the information about a product (appearing on the website and/or in the order confirmation) is inaccurate, Caracol can, in its sole discretion, refuse your order or cancel it, both before and after having accepted it. If a price is inaccurate, Caracol will cancel your order as well as all the fees that have been charged, then will contact you to invite you to place a new order at the exact price.

CANCELLATION

Caracol retains the right, in its sole discretion, to limit quantities, to terminate accounts and to refuse or cancel an order, including after the transfer of the order, even if it has been confirmed or accepted or billed to your credit card. If your order is cancelled after the treatment of your payment, you will get a full refund by Caracol.

PRICE ADJUSTMENT

Caracol does not offer the possibility of obtaining a price adjustment for purchases made online.

PAYMENT TERMS

The payment terms for the products purchased through this website are established in the sole discretion of Caracol. Payment will be made by credit card unless Caracol may have accepted another payment method, planned in advance. Payments made by credit card are subject to the approval of the financial institution that issued the credit card.

SHIPPING AND TAXES

Orders made online are processed and shipped within 24 to 48 business hours. All orders are shipped through Canada Post and should be delivered between 1 to 7 business days if the order is shipped in Canada.

Caracol will ship the products you ordered according to the shipping method you have chosen and to the address indicated in the order confirmation. The delivery period indicated by Caracol is approximate. Caracol accepts no responsibility with regard to damages or costs resulting from a late delivery.

Unless otherwise specified, prices do not include handling and shipping fees nor the applicable federal, state or provincial sales taxes. Handling and shipping fees will be presented separately in the order confirmation for each order, as the case might be. Canadian customers are subject to all the sales taxes, usage fees, goods and services taxes, harmonized sales taxes and other taxes and rights applied to the order. Orders placed from the United States are not subject to the Canadian Federal Goods and Services Tax, nor the applicable provincial sales taxes, nor the other Canadian taxes and rights applicable to a products order. However, American customers are subject to all the sales taxes, usage fees and other taxes and rights applied to their order that are imposed by a State or a territory in the United States.

OWNERSHIP; RISK OF LOSS

A third-party shipping company, in the form of a shipping contract, delivers all the products purchased from Caracol to you. You become the only owner of the products and assume the risks of loss from the moment where the company delivers the products to the third-party shipping company.

RETURNS

Any return of products is subject to the Return Policy of the company, of which terms are incorporated herein by reference.
